1. ACCEPTANCE AND USE OF SERVICES


A. Binding Agreement


This Terms of Service Agreement ("Agreement") constitutes a legally binding agreement made between you, whether personally or on behalf of an entity ("user" or "you") and letwash.com and its affiliated companies (collectively, "letwash.com" or "we" or "us" or "our"), concerning your access to and use of our car wash booking platform and all related services (collectively, the "Platform").


B. Platform Description


letwash.com operates a digital marketplace where independent car wash businesses ("Service Partners") can list their services and customers can discover, book, and pay for car wash services. We connect customers with local car wash providers but do not directly provide car washing services ourselves.


C. User Acknowledgment


By creating an account, downloading our app, making a booking, or otherwise using our Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must stop using our Platform immediately.


D. Information Use Authorization


By using our Platform, you authorize letwash.com to collect, process, and use your information as necessary to provide our services. This includes sharing relevant booking information with car wash partners and processing payments through third-party payment providers.


2. WHO CAN USE OUR PLATFORM


To use our Platform, you must meet certain age requirements. Adults who are 18 years or older may use the Platform without restrictions. Minors between the ages of 13 and 17 may only use the Platform with active parental supervision and consent, and a parent or guardian must review and agree to these Terms before the minor can use our services. Children under the age of 13 are not permitted to create accounts or use our Platform under any circumstances, in compliance with applicable children's privacy laws.

 

3. REGISTRATION


To access certain features of the Platform, you must register for an account ("Account"). You must provide accurate and complete information and keep your Account information updated. You shall not: (i) select or use as a username a name of another person with the intent to impersonate that person; (ii) use as a username a name subject to any rights of a person other than you without appropriate authorization; or (iii) use, as a username, a name that is otherwise offensive, vulgar or obscene.

You are solely responsible for the activity that occurs on your Account, and for keeping your Account password secure. You may never use another person's user account or registration information without permission. You must notify us immediately of any change in your eligibility to use the Platform, breach of security or unauthorized use of your Account. You should never publish, distribute or post login information for your Account. You shall have the ability to delete your Account, either directly or through a request made to one of our employees or affiliates.


4. PLATFORM SERVICES AND LIMITATIONS


A. Our Role


letwash.com operates as a digital marketplace platform that connects users with independent car wash service providers ("Partners"). letwash.com does not directly provide car wash services and does not own, operate, or control any car wash locations.


B. Available Services


The Platform enables users to access various services including, but not limited to:

●      Search for car wash services based on location, price, and service type

●      View Partner profiles, ratings, reviews, and service details

●      Make reservations at selected Partners

●      Process payments securely through integrated payment systems

●      Access promotional offers and referral programs

●      Receive notifications about bookings and service updates

●      Submit reviews and feedback about services


C. Platform Limitations


We do not guarantee that any content you access on or through the Platform is or will continue to be accurate. We are not responsible for issues including, but not limited to:

●      The quality, safety, legality, or availability of Partner services

●      Partner compliance with applicable laws and regulations

●      The accuracy of Partner information, pricing, or availability

●      Disputes between users and Partners

●      Partner facilities, equipment, or safety measures

●      Service delays, cancellations, or no-shows by Partners


5. USER SUBMISSIONS AND PLATFORM CONTENT


A. What We Consider Content

When we refer to "Content" in these Terms, we mean any material you share on our Platform, including but not limited to reviews, ratings, photos, comments, booking information, profile details, and any other data or materials you upload or submit through our services.


B. Your Responsibility for Submissions


When you post reviews, upload photos, or share any content on our Platform, you are fully responsible for what you submit. You must ensure that everything you share is truthful, appropriate, and doesn't violate any laws or infringe on others' rights. You also confirm that you have the right to share any photos or content you upload.


C. How We Can Use Your Content


When you share content on our Platform, you give us permission to use it to operate and improve our services. This means we can display your reviews to help other users, use your photos in promotional materials, and modify content as needed for technical reasons. You still own your content, but you're allowing us to use it for legitimate business purposes related to our Platform.


D. Content Management


We may review, edit, or remove any content from our Platform at our discretion. This could be for various reasons, such as inappropriate content, legal concerns, or technical issues. We're not required to monitor all content, but we reserve the right to take action when necessary to maintain a safe and useful platform for all users.


6. RULES OF CONDUCT


A. General Conduct


As a condition of use, you promise not to use the Platform for any purpose that is prohibited by these Terms. You are responsible for all of your activity in connection with the Platform.


B. Prohibited Activities


You shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any Content on or through the Platform, that:

  1. Infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity or violates any law or contractual duty

  2. You know is false, misleading, untruthful or inaccurate

  3. Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, obscene, vulgar, pornographic, offensive, profane, or otherwise inappropriate

  4. Constitutes unauthorized or unsolicited advertising, junk or bulk e-mail ("spamming")

  5. Contains software viruses or any other computer codes, files, or programs designed to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment

  6. Impersonates any person or entity, including any of our employees or representatives

  7. Includes anyone's identification documents or sensitive financial information

  8. Takes any action that imposes an unreasonable or disproportionately large load on our infrastructure

  9. Interferes or attempts to interfere with the proper working of the Platform

  10. Bypasses, circumvents or attempts to bypass or circumvent any measures we may use to prevent or restrict access to the Platform

  11. Runs any form of auto-responder or "spam" on the Platform

  12. Uses manual or automated software, devices, or other processes to "crawl" or "spider" any page of the Platform

  13. Harvests or scrapes any Content from the Platform

  14. Otherwise takes any action in violation of our guidelines and policies


C. Enforcement and Account Termination


We reserve the right, in our sole discretion, to suspend, terminate, or restrict your access to the Platform, with or without notice, for any violation of these Terms, including but not limited to any breach of the prohibited activities set forth above. We may also remove any content that violates these Terms and take any other action we deem appropriate to enforce compliance. You acknowledge that such suspension or termination may result in forfeiture of any credits, bookings, or other benefits associated with your account, and that we shall have no liability to you for such action.


7. BOOKINGS, PAYMENTS, AND BILLING


A. Booking Process


When you make a booking through the Platform:

●      You enter into a direct service agreement with the Partner

●      Payment is processed through our secure, third-party payment processors such as Stripe

●      Booking confirmation is subject to Partner availability and acceptance

●      Partners may impose additional terms and conditions for their services

 


B. Payment Methods and Future Changes


We accept major credit cards and other approved payment methods. All Platform transactions are secured with industry-standard encryption. The billing information on your payment method must match the billing address associated with your payment method.

We reserve the right to introduce service fees, modify existing charges, or update our policies at any time. Changes will be posted on the Platform and become effective upon posting. Continued use constitutes acceptance of any

C. Fees and Commissions


letwash.com may charge service fees for Platform usage and may receive commissions from Partners for bookings facilitated through the Platform. These fees and commissions may vary based on various factors including the type of service, booking value, and Partner agreements.


8. CANCELLATION POLICY


A. Cancellation Requirements


Cancellations must be made at least 2 hours before the scheduled service time to avoid fees. Late cancellations made less than 2 hours before your appointment may incur cancellation charges determined by the Service Partner. If you fail to appear for your scheduled service without prior cancellation ("no-show"), you may be charged the full booking amount. Cancellation fees and no-show charges vary by Partner and will be clearly displayed when you make your booking. We strongly recommend reviewing the specific cancellation policy for each Service Partner before confirming your reservation.


B. Service Changes


Changes to bookings (date, time, service type) are subject to Partner availability and may incur additional fees.


9. PROMOTIONS AND REFERRAL PROGRAMS


A. Promotional Offers


Promotional discounts are valid only at participating Partners and may have expiration dates, usage limits, geographic restrictions, and other terms. Discounts and referral rewards are valid only for new users and for the first booking. Some promotions are applicable only at selected partner car washes. We reserve the right to modify, suspend, or cancel promotions at any time without prior notice. Promotional benefits cannot be combined with other offers unless specifically stated, and promotional abuse may result in account termination and forfeiture of benefits.


B. Referral Program


From time to time, letwash.com may offer a referral program which enables you to earn credits by sharing a unique referral link with friends. To qualify for referral rewards, referred users must be new to the Platform, use your referral link to register, and complete a qualifying booking. Referral rewards are credited after successful service completion.


C. Abuse Prevention


Users must not abuse promotional offers or referral programs through activities such as creating multiple accounts, self-referring using false identities, referring existing customers, using spam or unsolicited communications, posting referral links on public forums or coupon sites, or providing false information. Any abuse of discounts, promotional offers, or referral systems may result in immediate forfeiture of all rewards, suspension of promotional privileges, and termination of your account at our sole discretion.


10. PARTNER RELATIONSHIPS


A. Independent Contractor Status

Partners are independent contractors and are not employees, agents, affiliates, or representatives of letwash.com. Partners operate their businesses independently and are bound by separate Partner Service Agreements that govern their participation on our Platform. Partners are solely responsible for:

●      Service delivery, quality, and customer satisfaction

●      Compliance with all applicable laws, regulations, and licensing requirements

●      Employment practices and worker classification

●      Facility safety, insurance, and liability coverage

●      Customer service for service-related issues

●      Setting their own prices, policies, and service terms


B. Partner Disputes


Any disputes, claims, or issues arising between users and Partners must be resolved directly between the parties. While letwash.com may facilitate communication or provide assistance, we are not responsible for Partner actions, service quality, or dispute resolution.


C. Partner Availability


Partners may modify their schedules, pricing, services, or availability at any time. letwash.com is not responsible for Partner closures, service changes, or unavailability.


11. THIRD PARTY SERVICES


The Platform may permit you to link to other websites, services or resources on the Internet, and other websites, services or resources may contain links to the Platform. When you access third party resources on the Internet, you do so at your own risk. These other resources are not under our control, and you acknowledge that we are not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources.

You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such website or resource.

A. Platform Ownership


The Platform, including all content, features, functionality, software, text, graphics, logos, and trademarks, is owned by letwash.com and protected by copyright, trademark, and other intellectual property laws.


B. Limited License


Subject to these Terms, we grant each user a worldwide, non-exclusive, non-sublicensable and non-transferable license to use the Platform solely for personal, non-commercial purposes in accordance with these Terms.


C. Restrictions


You shall not sell, license, rent, or otherwise use or exploit any Content for

commercial use or in any way that violates any third party right. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Content or information obtained from the Platform.


D. DMCA Notice


If you believe that any content on the Platform infringes your copyright, you may submit a DMCA takedown request to our designated agent at legal@letwash.com. Your notice should include a description of the copyrighted material, the allegedly infringing content, your contact information, and a statement made under penalty of perjury that your claim is accurate and that you are authorized to act on behalf of the copyright owner.


13. PRIVACY AND DATA PROTECTION

By using the Platform, you are consenting to have your personal data transferred to and processed in the United States and are consenting to the

terms of our Privacy Policy.


14. CORRECTIONS


Occasionally there may be information on the Platform that contains typographical errors, inaccuracies or omissions that may relate to service descriptions, pricing, availability, and other information. letwash.com reserves the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time, without prior notice.


15. DISCLAIMER OF WARRANTIES


We do not guarantee, represent or warrant that your use of our Platform will be uninterrupted, timely, secure or error-free. You expressly agree that your use of, or inability to use, the Platform is at your sole risk. The Platform and all services delivered to you through the Platform are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, and non-infringement.


16. LIMITATION OF LIABILITY


TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL LETWASH.COM, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE PLATFORM, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE PLATFORM OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

We shall not be liable for any damages or losses arising out of or related to the acts, omissions, or services provided by third-party partners, even if letwash.com has been advised of the possibility of such damages.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.


17. INDEMNIFICATION


You agree to indemnify, defend and hold harmless letwash.com and our affiliates, partners, officers, directors, agents, contractors, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.


18. SEVERABILITY


In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.


19. GOVERNING LAW AND JURISDICTION


For any dispute with letwash.com, you agree to first contact us at support@letwash.com and attempt to resolve the dispute with us informally. We will do our best to resolve the issue promptly and fairly, as user satisfaction and the quality of our services are our top priorities. We encourage open communication and believe most issues can be resolved through direct dialogue.

In the event that we have not been able to resolve a dispute through informal means within a reasonable time period, these Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware. You agree that any formal dispute arising from or relating to the subject matter of these Terms shall be governed by the exclusive jurisdiction and venue of the state and Federal courts of Delaware.


20. TERMINATION


We may modify, suspend, discontinue or terminate your access to the Platform, at our sole discretion at any time, with or without notice, in whole or in part, including but not limited to the Platform's features, functionality, and related services. We may terminate your account for violation of these Terms, misuse of the Platform, or for any other reason we deem appropriate.

If you wish to terminate your account, you may do so by contacting us at support@letwash.com or through your account settings. Upon termination of your account, whether by you or by us, you will lose access to your booking history, credits, and other account benefits.

Notice of termination by us shall be provided to you in the manner we deem reasonable, which may include email, Platform notification, or other electronic communication. All provisions of these Terms that by their nature should survive termination shall survive termination, including but not limited to warranty disclaimers, liability limitations, and indemnity obligations.


21. MODIFICATION


We reserve the right, in our sole discretion, to modify or replace any of these Terms, or change, suspend, or discontinue the Platform at any time by posting a notice on the Platform or by sending you notice through the Platform, via e-mail or by another appropriate means of electronic communication. Your continued use of the Platform following notification of any changes to these Terms constitutes acceptance of those changes.


22. GENERAL PROVISIONS


A. Electronic Communications


When you use our Platform or contact letwash.com, you are communicating with us electronically. You consent to receive communications from us electronically, including through email, SMS, push notifications, or by posting notices on our Platform. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communication be in writing.

 

 

B. Entire Agreement


These Terms of Service, together with our Privacy Policy, constitute the complete agreement between you and letwash.com regarding the Platform and supersede all prior understandings, agreements, representations, and warranties, both written and oral, regarding the Platform.


C. Severability


If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.


D. Assignment


These Terms are personal to you, and are not assignable, transferable or sublicensable by you except with our prior written consent. We may assign, transfer or delegate any of our rights and obligations hereunder without consent.


E. Force Majeure


We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation.

We are committed to making our Platform accessible to individuals with disabilities in accordance with applicable accessibility standards, including the Americans with Disabilities Act (ADA).
